By accessing or using Worldcheck's website, application, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet these requirements.
3.1 Account Registration: You may be required to create an account. You agree to provide accurate and complete information and to keep your information updated. 3.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.
5.1 Ownership: You retain ownership of content you submit, post, or upload ("User Content"). 5.2 License Grant: By submitting User Content, you grant Worldcheck a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display such content for purposes of operating and improving the Service. 5.3 Responsibility: You are solely responsible for your User Content and represent that you have all necessary rights to submit it.
All content provided by Worldcheck, including but not limited to text, graphics, logos, software, and trademarks, is owned by or licensed to Worldcheck and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.
7.1 Fees: Certain features may require payment. Fees are described at the time of purchase. 7.2 Billing: By providing payment information, you authorize us to charge applicable fees. 7.3 Refunds: Refunds are governed by our Refund Policy.
We may suspend or terminate your access to the Service at our discretion, including if you violate these Terms. Upon termination: Your right to use the Service ceases immediately. Sections intended to survive termination will remain in effect.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Worldcheck shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid by you (if any) in the past 12 months.
You agree to indemnify and hold harmless Worldcheck and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Florida, USA.
We may update these Terms from time to time. We will post the revised version with an updated "Last Updated" date. Continued use of the Service after changes constitutes acceptance.
